The United States, a constitutional republic, has a Constitution to
limit all three branches of the federal government which is composed of
the executive, the legislative, and the judicial. The Constitution gives
to each branch certain specific power, while at the same time limiting
the power by what it doesn’t give to them. That which isn’t stated in
the Constitution is forbidden to each branch and that which isn’t stated
is reserved to the people and the states respectively under the Ninth
and Tenth Amendments.

Unfortunately, the limited power provisions are no longer observed, and
since they aren’t, our government has evolved into a strange sort of
system resembling fascism with three dictators composed of the
executive, legislative, and the judicial. The President issues executive
orders which have no constitutional standing except when they are to
help his work of administering the executive offices. The President
constitutionally can’t issue orders to the general populace and yet it
is done, and if the orders aren’t obeyed, then it is a violation of the
law. Let’s call the unconstitutional executive orders Presidential
Fascism.

The next area of intrusion in the lives of the people is by Congress.
The elected representatives of the House and Senate routinely ignore the
limits of the Constitution, proposing bills and passing many into law,
and unfortunately most are unconstitutional. There doesn’t seem to be
any area of life that the politicians won’t enter with end result being
both the loss of freedom from government intrusion and the liberty to
conduct business, public and private, without the collective nose of the
camel invading the tent.

Congress, without any constitutional authority has decided to tell auto
and truck manufacturers to increase mileage of the vehicles. Most
members know very little about engineering, and yet they consider
themselves experts on vehicle performance. All of it is under the guise
of decreasing the nation’s use of energy. Baloney! The greater the
mileage of any vehicle the more it will be driven and the net gain for
less use of the energy resource will be zero.

The other area that is not one of the powers of government is setting a
minimum wage. Former Senator, John Edwards, wants to raise the minimum
wage to $9.50 by 2012. (See the Edwards malarkey at the bottom of the
article.) Just as with the vehicle mandates, Congress has no authority
to tell any business how much they must pay an employee. It is easy to
spout and dictate when the “spouter” has no financial interest in the
matter except appealing to voters in hopes it will gain him enough votes
so that one day he will be elected president.

In summation of the foregoing paragraph and the one about vehicle
mileage, let’s call those wacko ideas, only two of many, Congressional
Fascism.

The last area for a short examination is the judicial branch. The United
States Supreme Court has been eroding the Constitution for many years
with rulings against economic freedom, religious freedom, and education.
Working both in consort with and against the other two branches, the
justices rule with an iron hand to the extent that they make laws
instead of deciding issues. From prayer to abortion, the court has
unconstitutionally enacted legislation through wrong-headed reasoning
and thereby forced draconian rule onto the nation. Their wrong rulings
can be overturned, but Congress doesn’t have the will to do so, using
the excuse they can’t. (Yet, some members are screaming that they will
set aside the latest ruling against using race for admission to
schools.) The Constitution limits the power of the Supreme Court to
certain classes of cases and Congress can further limit its power as
well as the power of the inferior federal courts. Since Congress won’t
rein in the court, it has ridden roughshod over the rights of the people
(hopefully it will change with more conservative members attuned to the
Constitution) to appease liberal factions. We’ll call the court’s action
Judicial Fascism.

In summing up the series, while only a skimming of the various issues
was possible, it is apparent that our government is more and more
usurping powers not given to it in the Constitution. The rights of the
people are being trampled under the heavy heel of elected officials and
appointed bureaucrats, which includes the federal court system.
Undeniably, the nation faces a peril to freedom and liberty by the ones
who are supposed to safe guard them for us. The issue is clear. In
Sorting It Out, if the people do not end the power mad officials reign
through lawful process, there will come a day when jack booted thugs
will knock on the door and make demands that far exceed, “Let me see
your papers.” And they won’t say please.

Edwards Wants Minimum Wage Increased to
$9.50

enough for Democratic presidential candidate John Edwards. The former
North Carolina senator wants to increase the minimum wage again to $9.50
by 2012. The minimum wage was recently increased from $5.15 an hour to
$7.25. "Raising the minimum wage is one of the most important steps we
can take to lift working families out of poverty and into the middle
class," said Edwards, who also wants to index the minimum wage and tie
it to the national average wage. "No one who works full-time should have
to live in poverty," he added. "If a job takes you away from your family
every single day - or for many low-wage workers, all through the night -
it had better pay you enough to support them.""
